Personal Injury

Personal Injury Lawyers

At Schirmer Law, we fight for the compensation you need and deserve when injured through the negligence or wrongdoing of another party. Under Florida and Texas state laws, when such an event happens, you may be entitled to various types of compensation from the at-fault party or parties. This often involves dealing with an insurance company that may or may not act in an entirely fair manner in the claims process. That is why you may need the services of a personal injury lawyer who knows how to fight back against insurers who unfairly deny, delay, or minimize rightful compensation in an effort to uphold their profitability.

Our Personal Injury Services

Our Fort Lauderdale and Houston personal injury attorneys handle a wide variety of accident and injury cases including:

  • Car accidents
  • Rideshare accidents
  • Injuries sustained on another’s private property, such as slip and fall accidents, dog bites, and more
  • Injuries sustained while on the property of a business
  • Boating accidents
  • Motorcycle, bicycle, and pedestrian accidents
  • Workplace accidents due to third party negligence
  • Criminal attacks due to the property owner’s negligent security

Depending on the facts of your case, you may be entitled to compensation for your past and future medical expenses, pain and suffering, lost wages or income, property damage (such as to your vehicle), and emotional distress. At Schirmer Law, we start by analyzing the facts of your accident/injuries to determine how much your case may be worth. We can then give an in-depth summary of how the claims/litigation process works and what to expect. From there, our firm can handle the process for you while you concentrate on your recovery.

An important key to this process is seeking proper medical treatment after an accident so that your injuries are well-documented by the right medical professional in a timely manner. This is critical to proving injuries; without appropriate medical treatment from proper specialists, insurance companies will be less likely to provide compensation.

How Long Do I Have to File a Personal Injury Claim?

According to Florida Statutes Annotated section 95.11(3), you have four years to file a claim for your personal injury case. In the state of Texas, you have no more than two years to file a claim before the statute of limitations ends. If this happens before you file a claim, you will most likely lose your right to do so along with your right and opportunity to recover compensation. There are some exceptions that can change this four-year time period so it’s important to speak to an attorney about your case as soon as possible. Our firm offers free, no-obligation consultations so you have nothing to lose by contacting Schirmer Law today.

Damages and Your Personal Injury Case

While the specific amount of compensation an injury victim can recover in their personal injury case depends widely on the specifics of their accident and how their injuries have impacted their life, the types of damages an injured party can file for remain the same across all cases. These damages include:

  • Economic damages
  • Non-economic damages
  • Punitive damages

Economic damages compensate for financial losses that are directly related to an accident victims’ injuries, such as the cost of medical expenses or missed days at work.

Non-economic damages compensates for the abstract suffering associated with an injury, such as pain and suffering, or mental anguish. The last type of damages, punitive, is the least awarded out of the three. It differs from the first two in that their main purpose is to punish the negligent party instead of compensating an injured party.
